Speeches di Andrea Perronace
Patenting Artificial Intelligence and Internet of Things related Inventions
The speech will address the issue of the eligibility and patentability of Artificial Intelligence (AI) and Internet of Things (IoT) related inventions in Europe, defining the standards according to the reference jurisprudence of the European Patent Office (EPO) and focusing on open discussion about protection and ownership of AI outputs. The concepts of technical and non-technical features of an invention will be introduced by making reference to a number of examples and some statistics to show the pervasive and still increasing presence of computer-related matters in patents. The speech will show that, besides some theoretically complex hurdles in AI and IoT, the current situation is particularly favorable to the patenting of AI and IoT inventions, for the following reasons: - There is a fairly specific and stable jurisprudence of the EPO; - There is a continuous and accurate review of the EPO guidelines on ICT inventions; - The EPO model is increasingly followed in other jurisdictions (for example China); and - The flow of assessment of eligibility/patentability is well defined. Finally, the speech will give some hints as to improving IP strategy in the fields.Lingua speech: Italian
